NATIONAL HOME BUILDERS REGISTRATION COUNCIL (NHBRC) EXECUTIVE MANAGER: LEGAL, COMPLIANCE AND ENFORCEMENT PEROMNES: 03 CONTRACT TYPE: 5 YEAR CONTRACT REPORTING TO: CHIEF OPERATING OFFICER DEPARTMENT/SECTION: LEGAL, COMPLIANCE AND ENFORCEMENT (LCE) LOCATION: SUNNINGHILL PURPOSE OF THE POSITION: Reporting directly to the Chief Operations Officer, the Executive Manager: Legal Compliance and Enforcement is to advise Council, the Executive Committee and the organization on legal, regulatory, compliance and enforcement matters in a manner which supports the NHBRC to become the leading Regulator in the Home Building Industry. Lead and direct the LCE Team in excellence in the execution of National Home Builders Registration Council (NHBRC) strategic priorities aligned with the mandate.
• Develop and implement Divisional legal, enforcement, regulatory and compliance, and litigation management policies, procedures and/or frameworks to minimise and manage risks, ensure compliance and facilitate reporting requirements
• Provide innovative, practical and contemporary legal expertise to resolve significant and complex legal issues on behalf of the organisation • Lead and guide legislative processes relating to the mandate of the organisation to ensure compliance and up to date legislative environment. Risk, Compliance, Governance and Reporting: • Apply principles of good corporate governance and legislative compliance to the LCE Division • Manage corporate governance matters related to the Division •Develop Regulatory Compliance Strategy and Plan for implementation • Submit above strategy and plan to relevant Committees for approval • Monitor its implementation on a monthly and quarterly basis Submit reports for consideration, noting and/or approval to EXCO, relevant Committees of Council and/or Council • Monitor the management of both strategic and operational risks to ensure efficient mitigation. Stakeholder Relations: • Develop and maintain sound strategic relationships with relevant stakeholders to serve the interest of the of both the Division and the organisation • Establish and monitor healthy diverse workable internal and external relations and implement remedial actions where required, in the achievement of organizational goals • Represent the National Home Builders Registration Council (NHBRC) at all relevant committees and fora as and when required. Financial Management: • Accountable for the functional Financial Management of LCE Division • Resource the Division in line with the approved budget • Monitor Divisional spending and variances against budget • Monitor recovery of remedial costs, DC penalties, and taxed bill of costs from judicial- and quasi-judicial fora • Implement cost containment initiatives • Encourage the utilization of internal resources and expertise to drive cost efficiency where practical and possible • Establish goals for budget adherence and controls for relevant area. MINIMUM REQUIREMENTS: • Must hold a Master’s degree in Law and admission as an Attorney or Advocate • Minimum 10 years Legal Advisory experience • Minimum 6 – 10 years Legal experience in Public sector regulatory environment • Minimum 5 years’ experience operating at an Executive Management level. APPOINTMENT: The above-mentioned position will be offered on a 5-year contract with a Total-Cost-To-Company (TCTC) package.
